Conditions of Old and Rare Library Material Use




In the Republic of Serbia, the area of old and rare library material use and protection is legally regulated by the Law on Cultural Heritage (Official Gazette RS No 71/94), the Law on Old and Rare Library Material (Official Gazette RS No 52/11) and the Rulebook on the Thorough Conditions of Old and Rare Library Material Use (Official Gazette RS No 22/13). The above-mentioned legal regulations contain the following provisions, among others:

“Old and rare library material can be used if a declaration on the purpose of the use is provided.” (Rulebook on the Thorough Conditions of Old and Rare Library Material Use, Article 2, p. 2)

"Users can obtain copies of parts of publications obtained in the process of microfilming or digitization provided that they pay a fee determined in accordance with the law.” (Rulebook on the Thorough Conditions of Old and Rare Library Material Use, Article 5, p. 3)

“The title, name and semblance of a cultural heritage object can be used commercially only after the cultural heritage protection institution in charge of the protection of that cultural heritage object has given the authorization for such use. The Ministry of Culture and Information is in charge of issuing the authorization from paragraph 1 of this Article in case of the cultural heritage of exceptional importance.” (Law on Cultural Heritage, Article 73)

“A special authorization of a particular library is required for old and rare library material use for the purposes of advertisement, acquirement of material gain, multiplication or publishing of such material, provided that the appropriate fee is paid. Issuing the authorizations mentioned in paragraph 1 of the Article is a delegated affair.” (Law on Old and Rare Library Material, Article 43)



According to the abovementioned information, institutions and individuals with an interest in the use of digital representations of the old and rare library material categorized as cultural heritage objects for scientific, commercial or other purposes are required to contact the National Library of Serbia, the central library cultural heritage protection institution at srk@nb.rs.
